1. Who we are and who may use DM Butler

These terms are a contract between you and the provider named in our imprint ("we"). DM Butler is offered only to businesses (traders within the meaning of EU law), not to consumers. By signing up you confirm that you are at least 18 years old and that you act on behalf of a business that you are authorised to bind.

2. Account and team

• You sign in with a one-time code sent to your phone. Keep your phone and your team members' access secure.
• The workspace owner is responsible for what team members do in the workspace.

3. Subscription, trial and AI credit

• Plans, limits and prices (in euros, excluding VAT unless stated otherwise) are shown on the pricing page. A subscription renews for the chosen period unless you cancel before the end of the period.
• AI credit is separate from the subscription, does not expire, and is used only for replies the assistant actually sends.
• Because the service is for businesses only, the statutory consumer right of withdrawal does not apply. A period that has started is not refunded, unless the service did not work during that period because of us.
• Business customers in the EU outside our country of establishment are invoiced under the reverse-charge procedure when they provide a valid VAT ID.

4. The AI assistant

• The assistant answers your customers from the catalogue and knowledge you approve, and states prices, stock and order status only from live data. AI replies can still be wrong: you remain responsible for the information you provide and for any commitments made to your customers.
• As required by the EU AI Act, your customers are told that they are talking to an AI assistant. You must not hide or remove this notice or present the assistant as a human.
• You can take over any conversation or switch the assistant off at any time.

5. Your customers and minors

• You are the seller. You are responsible for selling lawfully, including consumer information duties, withdrawal rights, prices with VAT, delivery and refunds towards your customers.
• You must not use DM Butler to sell age-restricted goods or services (such as alcohol, tobacco, gambling or adult content) without your own age checks as required by law. If a customer says they are under 18, the assistant does not continue a sale and hands the conversation to your team.

6. Acceptable use

• Send marketing messages only to people who have agreed to receive them. Spam, fraud, illegal goods and collecting data without permission are not allowed.
• You must follow the terms of Instagram/Meta and Telegram. DM Butler uses only the official Meta API and enforces its limits (such as the 24-hour reply window).
• We may restrict or suspend accounts that break these rules, after notice where reasonable.

7. Data protection

For your customers' personal data we act as your processor under the Data Processing Agreement, which forms part of these terms. How we handle your own account data is described in the Privacy Policy. Your business data belongs to you; you can export it and delete your workspace at any time.

8. Availability and liability

• We aim for high availability and publish incidents on the status page. Outages of Instagram, Telegram, the internet or other third-party services are outside our control.
• We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under mandatory product liability law. For slight negligence we are liable only for breach of essential contractual obligations and limited to the foreseeable damage typical for this contract, at most the fees you paid in the 12 months before the event.

9. Changes and term

We tell you about material changes to these terms at least 30 days in advance in the panel. You will be asked to accept the new version; if you do not, you may cancel before it takes effect. You can cancel your subscription at any time with effect from the end of the current period.

10. Final provisions

The law of our country of establishment applies, excluding the UN Convention on Contracts for the International Sale of Goods. If a provision is invalid, the rest remains in effect. Questions: contact us.
